Terms and Conditions

The rules that apply when a guest uses the Waves N Wishes website, requests an itinerary or confirms a booking.

1. About these terms

These Terms and Conditions apply to the Waves N Wishes website, inquiries, proposals, reservations and concierge coordination. “Waves N Wishes,” “we,” “us” and “our” refer to the Bahamas-based concierge business identified on the booking confirmation. “Guest,” “client” and “you” refer to the person making the booking and all persons included in it. By using the website or authorizing payment, you agree to these terms and any service-specific terms disclosed before confirmation.

2. Our service

We design itineraries, source availability, arrange reservations and coordinate services supplied by independent yacht, boat, aviation, transportation, accommodation, restaurant, entertainment and activity operators. We remain your concierge point of contact, but the independent operator controls and performs its service. Vessel masters, pilots, drivers and venue managers retain final authority over safety, operations, routes, capacity and guest conduct.

3. Quotes and availability

A quote is an invitation to book, not a reservation. Availability and pricing may change until the required payment is received and written confirmation is issued. Images, specifications, menus, itineraries, travel times and amenities are illustrative unless expressly included in the confirmation. Equivalent substitutions may be proposed when an item becomes unavailable.

4. Client responsibilities

• Provide accurate names, ages, contact details, passenger counts, weights when required for aviation, accessibility needs, allergies and relevant medical or mobility information.
• Review the proposal, inclusions, exclusions, dates, pickup details and supplier terms before payment.
• Ensure every guest follows crew instructions, laws, safety rules and reasonable standards of conduct.
• Carry required identification, travel documents and personal medication.

5. Pricing and payment

Unless stated otherwise, prices are in US dollars. Applicable Bahamian VAT, gratuity, card-processing charges, deposits, security deposits and optional items are shown in the proposal or checkout. A booking is confirmed only when payment requirements are satisfied and written confirmation is issued. Further details appear in the Payment and Card Processing Terms.

6. Changes and cancellations

Requests to change a confirmed booking are subject to availability, supplier approval and any price difference or change fee. Cancellation, refund and weather rules appear in the separate policies provided at checkout and form part of these terms.

7. Safety, conduct and assumption of risk

Travel by sea, air and road and participation in water or adventure activities involve inherent risks. Guests must follow all safety briefings and use required equipment. An operator may refuse boarding, restrict an activity or end a service when conduct, intoxication, health, weather, capacity or safety creates a risk. Illegal drugs, weapons, abuse, harassment and deliberate damage are prohibited. Costs caused by guest misconduct or damage may be charged to the responsible client to the extent permitted by law.

8. Operator terms and responsibility

Each confirmed service may also be governed by the operator’s contract, ticket, waiver or onboard rules. Those documents apply to the operator’s performance. If there is a conflict about safety or operation, the operator’s terms and lawful instructions control. The separate Charter and Operator Responsibility policy provides more detail.

9. Events outside reasonable control

Neither Waves N Wishes nor an operator is responsible for delay, change or inability to perform caused by events outside reasonable control, including severe weather, sea conditions, airport or port restrictions, government action, civil disruption, infrastructure failure, mechanical issues that could not reasonably be prevented, illness, or other force majeure events. Available remedies depend on the affected service, recoverable funds and applicable law.

10. Liability

Nothing in these terms excludes liability that cannot legally be excluded. To the fullest extent permitted by law, Waves N Wishes is responsible for its own concierge and coordination services, not the negligent or wrongful acts of an independent operator. We do not guarantee uninterrupted website access, exact wildlife sightings, exact routes or subjective satisfaction. Any claim should be reported promptly with supporting details so it can be investigated.

11. Website content and intellectual property

Website copy, itineraries, branding, design and original media belong to Waves N Wishes or are used with permission. They may not be copied, resold or commercially reused without written consent. Links or third-party content do not constitute a guarantee of the third party.

12. Privacy and communications

Personal information is handled under the Privacy Policy. By requesting a booking, you authorize service-related communications by email, telephone or messaging. Marketing messages are sent only where permitted and may be opted out of.

13. Complaints and disputes

Please first contact concierge@wavesnwishes.com and allow a reasonable opportunity to resolve the matter. These terms are governed by the laws of the Commonwealth of The Bahamas. Subject to any mandatory consumer right, the courts of The Bahamas have jurisdiction.

14. General

If part of these terms is unenforceable, the remaining terms continue. A delay in enforcing a right is not a waiver. The booking confirmation, incorporated policies and disclosed operator terms form the agreement for the booking. We may update website terms prospectively; the version accepted at confirmation continues to govern that booking.
