Charter and Operator Responsibility
The division of responsibility between Waves N Wishes, independent service operators and guests.
1. Waves N Wishes as concierge and coordinator
Waves N Wishes is the guest’s planning and coordination point of contact. We identify suitable options, communicate availability and inclusions, arrange reservations, coordinate logistics and help resolve issues. We may collect payment or facilitate payment as stated in the booking documents.
2. Independent operators
Yacht owners, charter companies, vessel operators, aircraft operators, drivers, venues, caterers, guides and activity providers are independent businesses. They are responsible for the equipment, personnel, licenses, insurance and safe performance of the services they supply, subject to their own contracts and applicable law.
3. Authority during a service
The vessel master or captain controls navigation, speed, route, anchoring, passenger capacity, boarding, alcohol-related safety and use of water toys. The pilot controls all aviation decisions. Drivers and venue managers control their respective operations. Their lawful safety instructions must be followed even when that changes the planned itinerary.
4. Operator substitutions and changes
Mechanical, staffing, regulatory, weather or operational issues may require a change of vessel, aircraft, pickup point, route or supplier. Where possible, Waves N Wishes will coordinate a comparable option and obtain client approval for any material price difference. Safety-critical changes may be made without advance approval when immediate action is reasonably necessary.
5. Guest responsibilities
The lead client must provide complete and accurate information, communicate rules to the group, ensure minors are supervised and disclose needs that may affect safe performance. Guests are responsible for personal belongings, appropriate conduct and damage they cause. An operator may refuse or stop service because of unsafe behavior, intoxication, harassment, illegal activity or refusal to follow instructions.
6. Documents and waivers
An operator may require a charter agreement, manifest, identification, waiver, medical disclosure or security deposit. Completion may be a condition of service. Waves N Wishes may transmit these documents for convenience, but the agreement for operating the service remains between the client and the identified operator unless the booking expressly states otherwise.
7. Concerns and claims
Raise an onboard safety concern immediately with the captain or operator and notify Waves N Wishes as soon as possible. Claims should include photographs, receipts and a clear description. We will assist with communication but cannot admit liability or settle a claim on an independent operator’s behalf.
8. No reduction of mandatory rights
Nothing in this policy removes a right or responsibility that applicable law does not allow the parties to exclude.
